State concussion laws and sport-league policies are important tools for protecting public health, but also present implementation challenges. Both state laws and league policies often require athletes provide written acknowledgement of having received concussion-related information and/or of their responsibility to report concussion-related symptoms. This paper examines these requirements in two ways: an analysis of the variation in state laws and sport-league policies and a study of their effects in a cohort of collegiate football players.

This study examined the extent to which concussion management plans at National Collegiate Athletic Association member schools were in line with NCAA Concussion Policy and best practice recommendations in absence of any process to ensure compliance. Most schools' concussion management plans were in compliance with 3 or 4 of the NCAA's 4 required components. Annual athlete education and acknowledgement was the requirement least often included, representing an area for improvement. BackgroundFigure-disembedding is one of the most discussed visuo-cognitive functions, in which individuals with Autism Spectrum Disorder have been reported to outperform non-autistic individuals. A local processing bias has been assumed to underlie such superior performance patterns. The aim of the current study is to investigate whether processing preferences can be modified by procedural priming.MethodThe current study used a procedural priming task to induce more local or global processing in 25 autistic and 21 typically developing control participants, using hierarchical figures preceding (...) the figure-disembedding task.ResultsParticipants with ASD outperformed non-autistic individuals in the unprimed baseline task version. The performance was not modulated by priming in either direction in both groups. However, the performance of TD control participants was improved by training to the same level as that observed in the ASD group.ConclusionFigure-disembedding performance in ASD is superior to that in TD control participants and robust against procedural priming or training. In contrast, performance in the TD control group can be improved up to the level of the ASD group. Any studies reporting superiority in individuals with ASD in figure-disembedding should consider training effects when evaluating group differences. (shrink)

The inclusion of stakeholders and knowledge systems is increasingly valued in research to address complex socio-ecological challenges around the world. Often these projects take place in cross-cultural setting where external researchers risk perpetuating historically extractive research models that not only harm local communities but damage the validity of research projects. Responsible community engagement is increasingly recognized as a practice that can improve researcher-community relationships and research quality by incorporating principles of ethics, reciprocity, and power sharing. In partnership with local community (...) leaders, researchers from a U.S. university coded 76 research articles for indicators of responsible community engagement conducted in the Samburu, Kenya community since 2000. Findings from this study suggest that most of the research in Samburu has followed extractive models. Of the 76 articles reviewed many failed to acknowledge ethical protocols, did not address relevance of the study to the local community, and did not report any indication of outreach or community change as a result of the research. While a portion of articles showed evidence of community involvement in the studies, the involvement was primarily limited to secondary roles with little to no shared decision-making power over the research process. We discuss methodological considerations for future research and steps that must be taken in order to shift the norm and practice of academic research in sites such as Samburu, Kenya. (shrink)

Well before patient-centered or patient-controlled research became trendy, and earlier than calls to preferentially refer to research subjects as participants, Bob Veatch wrote “The Patient as Partner” Veatch presciently argued that research patients should not be thought of as passive subjects nor material from which to obtain data, but rather as partners in discovery. In this manuscript, I will explore Veatch’s conception of patient as partner in research and how that idea has evolved and been implemented over time and consider (...) some of the remaining challenges. Complexities of patient partnership include: clarifying the types of research in which patient partnership is most appropriate, recognizing the various possible levels of patient engagement in each case, avoiding tokenism and striving for respectful partnership, and keeping in mind the appropriate implementation of protections and safeguards. Bob Veatch would be pleased with the progress that has been made in creating research partnerships with patients, while also undoubtedly pushing us to continue to do better. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:preface This special issue of Feminist Studies presents an eclectic view of women ’s friendships from across Western history and from several different cultures. Several of the articles question whether identity or sameness is a prerequisite for friendship and ask what friendships across difference look like, including charting the difficulties of making and sustaining such friendships. The articles in this issue contrast the variety and functions of women’s friendships (...) with the narcissistic masculinist ideals of classical Western thought about friendship in which friends serve as reflections of a person—typically a male and upper-class person. The authors in this issue present women’s friendships that are more pragmatic and more vulnerable and that contend more fully with difference. Some authors reflect on the high expectations placed on friendship within Second Wave feminism in the United States, noting how competition and feelings of betrayal can suffuse friendships; others trace more autonomous, productive, and forgiving contemporary visions of friendship. The issue opens with Susan Van Dyne’s archival study of student friendships in a pioneering US women’s college, revealing how love, flirtation, and desire between women was expressed in Smith College’s class of 1883. In another historical study, sociologist Harriet Bjerrum Nielsen contrasts the narratives of Norwegian girls and young women from the late nineteenth century with those of present-day women and girls, noting differences between rural and urban contexts. Ivy Schweitzer 272Preface surveys classical Western masculinist ideals of friendship from Aristotle to Montaigne and traces the transformation of this tradition into the present quest for equality without hierarchy. Alexandra Verini addresses models of female friendship in the European Middle Ages, arguing that Christine de Pizan and Margery Kempe illustrate a “viable female alternative ” to classical models. The vulnerability of women’s close relationships comes to the fore in Nancy K. Miller’s moving elegies for deceased feminist friends, while Judith Taylor explores the more open and autonomous friendships adumbrated in contemporary fictions by Zadie Smith and Jillian and Mariko Tamaki, themes also addressed in Judith Kegan Gardiner’s review essay of advice books on friendships between women and other studies of women’s friendships. Richa Nagar’s interview articulates an ideal of feminist friendships that “enable continuous evolution of our beings and mindsets... without feeling threatened by one another.” If our articles focus on the close bonds between women, our News and Views pieces in this issue point to collective ties formed in response to political and social threats: Dalia Abd El-Hameed and Nadine Naber describe responses by Egyptian feminists to government crackdowns, and our forum “Orlando: Observances” offers a selection of first-person accounts from vigils organized to mark the massacre at the Pulse nightclub this summer. This issue also presents internal negotiations of identity, identification, and body image in Stephanie Han’s short story and in the vivid and bold transgressions of Wangechi Mutu’s collages as described by Sarah Jane Cervenak. In “‘Abracadabra’: Intimate Inventions by Early College Women,” Susan Van Dyne takes us on a fascinating journey into the “the early formation of a homosocial student culture and the bonds between women” at Smith College in the late nineteenth century. Mining an archive of diaries, letters, photos, and other materials from a group of friends from the class of 1883, she focuses on two kinds of written evidence: one, the inchoate expressions of homoerotic desire in one student’s journal at a moment when “lesbian” did not yet exist as an identity, and the other, a love poem to two students, written as a parody by one of their women professors, but which reverberated beyond the college and ignited male opprobrium. In her discussions of these developments, rather than ascribing identity, Van Dyne navigates the “messiness” of the archive, keeping her eye trained on the “only partially intelligible strategies of self-representation that can’t be translated or reduced to the modern Preface 273 language of sexual self-recognition.” What is most surprising in her account is not that young women would feel desire for one another, nor that male peers or authorities might find this threatening, but that the fabric of the students’ homosocial community had such resilience, nurturing... Neo-sentimentalism is the view that to judge that something has an evaluative property is to judge that some affective or emotional response is appropriate with respect to it. The difficulty in assessing neo-sentimentalism is that it allows for radically different versions. My aim is to spell out what I take to be its most plausible version. I distinguish between a normative version, which takes the concept of appropriateness to be normative, and a descriptive version, which claims that appropriateness in emotions (...) is a matter of correspondence to evaluative facts. I argue that the latter version can satisfy the normativity requirement that follows from Moore’s Open Question Argument, that it is superior to the former with respect to the explanatory role of values, and with respect to the Wrong Kind of Reason Objection. Finally, I argue that the circularity that is involved is not vicious: understood epistemically, neo-sentimentalism remains instructive. (shrink)

To understand the human capacity for psychological altruism, one requires a proper understanding of how people actually think and feel. This paper addresses the possible relevance of recent findings in experimental economics and neuroeconomics to the philosophical controversy over altruism and egoism. After briefly sketching and contextualizing the controversy, we survey and discuss the results of various studies on behaviourally altruistic helping and punishing behaviour, which provide stimulating clues for the debate over psychological altruism. On closer analysis, these studies prove (...) less relevant than originally expected because the data obtained admit competing interpretations – such as people seeking fairness versus people seeking revenge. However, this mitigated conclusion does not preclude the possibility of more fruitful research in the area in the future. Throughout our analysis, we provide hints for the direction of future research on the question. (shrink)

The aim of this paper is twofold: In its first part, we work out the key features of constitutivism as presented by Christine Korsgaard. This reconstruction serves to clarify which goals Korsgaard wants to achieve with her account and which of its central claims she has to defend in particular. In the second part, we discuss whether Korsgaard can vindicate constitutivism's most central claim. To do this, we analyse two important arguments - the argument from unavoidability and the argument (...) from the abstract constitutive principle - that have been made in support of constitutivism. We show how both these arguments go amiss and conclude that at least for now, constitutivism's most central claim has not been successfully argued for. (shrink)

Personal autonomy is often taken to consist in self-government or self-determination. Personal autonomy thus seems to require self-control. However, there is reason to think that autonomy is compatible with the absence of self-control. Akratic action, i.e., action performed against the agent’s better judgement, can be free. And it is also plausible to think that free actions require autonomy. It is only when you determine what you do yourself that you act freely. It follows that akratic actions can be autonomous. At (...) least in some cases, it is the agent herself, and not some alien part of her, who determines her akratic actions. But akratic actions are usually thought to be paradigm cases of self-control failure. Thus, we have reason both to conclude that autonomy requires self-control and that autonomy is compatible with the absence of self-control. My aim is to discuss the main solutions to this paradox. Christine Battersby is a leading thinker in the field of philosophy, gender studies and visual and literary aesthetics. In this important new work, she undertakes an exploration of the nature of the sublime, one of the most important topics in contemporary debates about modernity, politics and art. Through a compelling examination of terror, transcendence and the ‘other’ in key European philosophers and writers, Battersby articulates a radical ‘female sublime’. A central feature of _The Sublime, Terror and Human Difference_ is (...) its engagement with recent debates around ‘9/11’, race and Islam. Battersby shows how, since the eighteenth century, the pleasures of the sublime have been described in terms of the transcendence of terror. Linked to the ‘feminine’, the sublime was closed off to flesh-and-blood women, to ‘Orientals’ and to other supposedly ‘inferior’ human types. Engaging with Kant, Burke, the German Romantics, Nietzsche, Derrida, Lyotard, Irigaray and Arendt, as well as with women writers and artists, Battersby traces the history of these exclusions, while finding resources within the history of western culture for thinking human differences afresh _The Sublime, Terror and Human Difference_ is essential reading for students of continental philosophy, gender studies, aesthetics, literary theory, visual culture, and race and social theory. Background Teaching ethical competencies is an essential component of professional and postgraduate curricula. Developing practical–ethical problem-solving competencies as well as appraising program-specific studies and related research ethics are topics typically addressed. However, assessment of these ethical competencies poses a challenge. Written or oral assessment formats addressing relevant learning objectives is mainly limited to knowledge testing alone, often not capturing relevant skills or attitudes pertinent to those competencies. Aim During the reaccreditation of the masters of science program in Nursing Science at (...) Witten/Herdecke University, this challenge was addressed by implementation of an innovative examination format for postgraduate education. Procedure For the module “Ethics in nursing practice and research” a format based on the Objective Structured Clinical Examination format was developed. This assessment method incorporates evaluation of acquired skills and attitudes of nursing students. Conclusion The article demonstrates development and adaption of the OSCE format for this purpose. A number of important city-building projects across the early 20th century drew on the utopian ideas of the City Beautiful movement, an architectural response to the poverty and social dysfunctions generated by urban industrialism. This was also a moment in which the imperial connections and imperial ambitions of settler capitalist societies coincided with national projects. The curious co-existence of these ambitions was embodied in the capital city projects of the time – simultaneously imperial and national, and developed through an exchange (...) of utopian ideas about architecture, planning, nature and modernity. Of these, Canberra is exemplary; the most fully realized. A hundred years later, its story is still largely told in narrow terms, as a parochial tale of incomplete nationalism. Shifting focus to explore Canberra in relation to other capital city building projects during the period offers a better understanding of the complex overlays of imperialism, nationalism and regionalism at play in new world settler societies, and the cultural traffic across the Anglophone world. A défaut de traiter d’amour, cet ouvrage analyse les méandres de l’aide à sens unique. L’altruisme, ce comportement de don sans attente de retour de service, est abordé ici de manière scientifique et philosophique plutôt que poétique et littéraire. Un objectif est d’en traquer les mécanismes sous-jacents, ceux qui échappent (...) à tout romantisme et se traduisent souvent en calculs de coûts et bénéfices. Il s’agit également d’approfondir les diverses manières de comprendre et de pratiquer l’altruisme. Souvent considéré comme une des plus grandes vertus humaines, l’objet de nombreux écrits philosophiques et psychologiques, l’altruisme peut-il se trouver chez les abeilles et les marmottes ? Posez la question à un biologiste de l’évolution et il vous répondra « Mais oui, évidemment ! ». A première vue, une telle réponse est consternante mais nous verrons qu’à y regarder de plus près, les philosophes et les biologistes ne parlent pas exactement de la même chose en utilisant le même terme. L’hétérogénéité des disciplines intéressées à l’altruisme et des contextes théoriques dans lesquels il est utilisé en ont fait une notion extrêmement complexe et difficile à saisir. Au sein des différentes sciences sociales et du vivant, l’altruisme est un élément pivot dans trois débats dont cet ouvrage prend le temps de retracer les contours. Tantôt, l’altruisme se profile en danger (apparent) pour la théorie de l’évolution darwinienne (chap. 1), tantôt, il sert de cheval de bataille dans la croisade contre l’idéal de l’homo economicus si souvent prôné en économie (chap. 2 et 3), tantôt il est une énigme à découvrir dans les méandres de nos motivations intimes (chap. 3). Dans le cadre de ces différents débats, la notion d’altruisme prend des significations sensiblement différentes. Pour en rendre compte, l’ensemble de l’ouvrage s’articule autour d’une triple distinction fondamentale : l’altruisme peut être compris au sens biologique, comportemental ou psychologique. Chacune de ces notions est utilisée dans un contexte spécifique au sein de sciences qui ont leurs propres traditions et leurs propres débats internes. La structure de l’ouvrage est organisée en fonction de cette triple distinction. Le premier chapitre est consacré à l’altruisme biologique, définit en termes de valeur de survie et de reproduction (fitness) : un comportement est altruiste s’il a pour effet d’augmenter la fitness d’autrui aux dépens de sa propre fitness. L’observation de comportements altruistes au sein du monde animal a posé un des plus grands défis à la théorie de l’évolution depuis la publication de l’Origine des espèces. Des générations de biologistes se sont attelés à la tâche d’expliquer comment un comportement qui augmente la fitness biologique d’autres organismes aux dépends de la fitness de l’agent a pu être sélectionnée au fil de l’évolution. Nous verrons que c’est grâce aux travaux de William Hamilton et d’autres que cette difficulté a pu être résolue. Le deuxième chapitre retrace les attaques d’une frange d’économistes (supportés dans leur effort critique par des théoriciens des jeux et anthropologues évolutionnistes), contre le modèle classique de l’homo economicus. Leur objectif est de montrer que des personnes ordinaires ne se comportement souvent pas en maximisateurs rationnels de leurs gains propres, comme le prédirait la théorie économique néo-classique. Dans le cadre de ce débat, c’est du comportement social spécifiquement humain et plus particulièrement de l’altruisme humain dont il est question. Le terme d’altruisme est alors utilisé dans un sens plus lâche que ne le font les biologistes ; ce que l’on appellera l’altruisme comportemental comprend les actions coûteuses pour l’agent et avantageuses pour autrui. La particularité humaine fournira également l’occasion de traiter la délicate question des rapports entre l’évolution génétique et la culture. Nous verrons que l’étude du comportement animal fournit les premiers éléments d’explication de l’altruisme humain, mais ce dernier ne peut être pleinement compris qu’au terme d’une analyse qui tient compte des capacités qui nous sont propres. Cette analyse nous permettra de saisir pourquoi les êtes humains sont à la fois plus sociaux et plus opportunistes (la contradiction n’est qu’apparente) que les autres espèces animales. Malgré leurs différences, les versions biologique et comportementale de l’altruisme sont très proches au sens où elles traitent des conséquences de comportements. Ces notions ne reflètent qu’imparfaitement la conception ordinaire que nous nous faisons de l’altruisme. L’altruisme tel qu’il est utilisé dans le langage courant correspond davantage à l’image que s’en font les philosophes et les psychologues. Pour déceler les actions altruistes, ces derniers se demandent généralement si elles ont été causées par un motif dirigé vers le bien d’autrui. En ce sens, on parle d’altruisme psychologique qui réfère aux causes plutôt qu’aux effets des actions d’aide. Le troisième chapitre est consacré aux débats qui font rage autour de la question de savoir si les êtres humains sont capables d’agir de manière altruiste psychologique, c’est-à-dire en fonction de motifs exclusivement dirigés vers le bien-être d’autrui. Nous verrons à quel point cette tâche est ardue à moins d’accepter de reformuler la question en termes de motivation primaire à l’action. Au terme de l’analyse, il apparaitra que les trois notions d’altruisme se croisent sans se recouper dans un enchevêtrement de liens plus ou moins complexes. Nous verrons par exemple que l’altruisme biologique (voire comportemental) pourrait bien être une condition nécessaire à l’évolution de l’altruisme psychologique ; des liens tangibles peut ainsi être tissés entre ces différentes notions. Les diverses approches du phénomène de l’altruisme retracées dans cet ouvrage fournissent également des clefs de compréhension des méandres du comportement social animal et plus particulièrement humain. De manière générale, sans apporter de solutions toutes faites, cet écrit peut servir de guide sémantique et initie le lecteur à une littérature interdisciplinaire émergeante, foisonnante, passionnante quoique encore souvent parsemée de confusions et de contradictions. This paper is the latest in a debate with Robert Larmer as to whether the occurrence of a miracle would provide evidence for the existence of God or against the existence of God. Whereas Larmer’s view is categorical (miracles occur and are evidence for the existence of God), mine is hypothetical (if the events typically described as miracles were to occur -- although I do not believe they do -- they would be evidence against the existence of God). The reason (...) is that miracles, if they were to occur, would be ontic, epistemic, and moral evils. (shrink)

Polus admires orators for the tyrannical power they have. However, Socrates argues that orators and tyrants lack power worth having: the ability to satisfy one's wishes or wants (boulēseis). He distinguishes wanting from thinking best, and grants that orators and tyrants do what they think best while denying that they do what they want. His account is often thought to involve two conflicting requirements: wants must be attributable to the wanter from their own perspective (to count as their desires), but (...) wants must also be directed at objects that are genuinely good (in order for failure to satisfy them to matter). We offer an account of wanting as reflective, coherent desire, which allows Socrates to satisfy both desiderata. We then explain why he thinks that orators and tyrants want to act justly, though they do greater injustices than anyone else and so frustrate their own wants more than anyone else. (shrink)

This paper is concerned with events that were the subject of an inquest into the deaths of 12 children who died while undergoing or shortly after having undergone cardiac surgery at the Winnipeg Health Sciences Centre, Manitoba, Canada, during 1994. A notable finding of the Sinclair Inquest was that nurses involved with the pediatric cardiac surgery program were concerned about the competence of the surgeon and made sustained efforts throughout 1994 to have these concerns addressed. That the nurses’ concerns were (...) not taken seriously is the central problem of this paper. Essentially, the position articulated is that gendered and gendering discourses constituted a form of power that structured the field of nurses’ possible actions. These discourses constituted a resource to make nurses knowable, to produce them as certain forms of the person, and were therefore part of what governed nurses everyday conduct. Though neither simply good nor bad in themselves, in this case, these discourses had constraining effects on how nurses were able to conduct themselves. (shrink)

Some have contested the Industrial Revolution’s status as a climactic event bringing social and political upheaval. However, the abolishment of slavery, the destruction of traditional ways of life, and the rise of class-consciousness confirm the climactic nature of this period. In analyzing the dramatic changes in the social organization of British society, this paper aims to reclaim the title of the Industrial Revolution as just that--revolutionary.

We consider an integrable, nonlocal and nonlinear, Schrödinger equation as a model for building space–time patchings in inhomogeneous loop quantum cosmology. We briefly review exact solutions of the NNSE, specially those obtained through “geometric equivalence” methods. Furthemore, we argue that the integrability of the NNSE could be linked to consistency conditions derived from LQC, under the assumption that the patchwork dynamics behaves as an integrable many-body system.

This paper aims at transforming the nexus institution–passivity into a vibrant interrelation. With this goal on my mind, I will refer to Arnold Gehlen and his controversial discussion of the state as the most powerful institution that offers an analysis not only of the complexity of institutions but also of the genuinely paradoxical nature of the institution. Seen from the perspective of philosophical anthropology, institutions are, on the one hand, inextricably intertwined with restriction and passivity, but, on the other hand, (...) the restriction and passivity fostered by the institution must be understood as the pre-condition of an action and therefore as a force of freedom. In order to outline this thought, the paper focusses on Gehlen's last book Moral und Hypermoral (1969) and presents the institution of the state as a social-political form from which a critique – that is, a rethinking of the concept of the institution – could start. The historic Christian tradition of offering hospitality to strangers provides moral, theological and practical insights for contemporary responses to the needs of refugees, asylum seekers and immigrants. Ancient writers were explicit about the difficulties, blessings, and necessity of welcoming strangers. In this paper, specific components of the tradition, especially as they are evident in the writings of Chrysostom, Calvin and Wesley, are discussed. Suggestions are offered for points of intersection with contemporary concerns related to asylum and immigration.

This Article examines the ways in which market vendors in Kampala, Uganda, responded to plans to redevelop their markets through the concession of long-term leases to private investors. These plans met with massive resistance from the marketers, with significant outcomes. The Article uncovers how the marketers actively negotiated a “gray space” between legality and illegality and creatively used the law, with a view to asserting themselves as the legitimate rulers of their markets. It shows how the marketers engaged in highly (...) diverse modalities of struggle, stretching across the legal/illegal boundary. They organized in multiple configurations which were flexible, hybrid and mutant in character, rather than being fixed in particular organizational categories. In their struggles, the marketers engaged in shifting alliances and with a disparate range of political allies. Their politics were fluid, untamed and pragmatic, but also contradictory and fractured. This flexibility and pragmatism enabled them to navigate a complex political landscape and to make instrumental use of a generally unfavorable legal environment. (shrink)

In this commentary, I describe how experiments recently carried out by Caldwell and colleagues can contribute to the understanding of such phenomena.
